Terms of Service

These Terms of Service (“Terms”) govern your use of www.brainwiz.in and the programmes offered by Brainwizard Solutions Private Limited (“Brainwiz”, “we”, “us”), including the Brainwiz AI Assessment (the “Services”). By making a purchase or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who can use the Services

• Purchases must be made by a parent or lawful guardian aged 18 or older (“you”).
• The AI Assessment is designed for children aged 12 to 18 (“the child”).
• You are responsible for giving consent on the child’s behalf, supervising their use of the Services as appropriate, and making sure the information you provide is accurate.

2. What the AI Assessment is, and what it is not

The AI Assessment is an online, interactive educational and developmental assessment. The child works through realistic challenges with an AI companion, and we produce a personalised report on how they think, question, evaluate and use AI.

It is not an IQ test, and not a medical, clinical, psychological or diagnostic assessment. The report reflects the child’s performance during one assessment session and is intended to support conversations about learning. It should not be used as the sole basis for educational, medical or other significant decisions. If you have concerns about your child’s development or wellbeing, please consult a qualified professional.

3. Purchases, pricing and payment

• Prices are shown in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
• Early Access is a limited introductory offer. We may change prices for future purchases, but a change will not affect a purchase you have already completed.
• Payments are processed securely by our third-party payment partner. We do not store your full card or bank details.
• Each purchase covers one assessment for one child, unless stated otherwise at checkout.

4. Access and delivery

• After payment, we send the assessment access link to the email address you provide.
• The assessment can be taken online on a smartphone, tablet, laptop or desktop with a stable internet connection. It takes approximately 30 to 45 minutes.
• The access link is valid for 90 days from purchase and may be used once.
• We aim to deliver the report within 7 working days of the assessment being completed.

5. Refunds and cancellations

Refunds and cancellations are covered by our Refund & Cancellation Policy.

6. Acceptable use

You agree, and will make sure the child agrees, not to:

• Share access links or let anyone other than the registered child take the assessment.
• Try to copy, reverse-engineer, scrape or misuse the assessment, its questions or its AI companion.
• Try to make the AI companion produce harmful, abusive or inappropriate content.
• Upload or share personal contact details, or anything unlawful, during the assessment.

We may suspend access if these Terms are breached, and in serious cases may do so without a refund.

7. AI-generated content

The AI companion is designed to support the assessment and may sometimes give incorrect or incomplete answers. In some tasks this is intentional, to see whether the child notices and questions it. AI responses during the assessment should not be relied on as factual advice.

8. Intellectual property

The website, assessment content, tasks, scoring framework, report format, brand names and logos belong to Brainwizard Solutions Private Limited or its licensors. Your child’s report is provided for your personal, non-commercial use. You may share it with your child’s school or educators.

9. Privacy

Our Privacy Policy and Child Data & Safety page explain how we handle personal data. They form part of these Terms.

10. Availability

We work to keep the Services available and working well, but we cannot guarantee uninterrupted access. If a technical problem on our side stops the child from completing the assessment, we will offer a free re-attempt or a refund as set out in our Refund & Cancellation Policy.

11. Limitation of liability

To the extent permitted by law, the Services are provided “as is”. Brainwiz is not liable for indirect or consequential losses, or for decisions made on the basis of a report. Our total liability for any claim relating to a purchase will not exceed the amount you paid for it. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019.

12. Changes to these Terms

We may update these Terms from time to time. The version in force when you make a purchase applies to that purchase. We will post changes on this page with a new “Last updated” date.

13. Governing law and disputes

These Terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any concern. Subject to your rights as a consumer, the courts at New Delhi, India will have jurisdiction.

14. Contact and grievances

For questions about these Terms, or to raise a grievance, email us with “Grievance” in the subject line. We will acknowledge your complaint within 48 hours and aim to resolve it within 30 days.
